Gabon/ La Plateforme « GABON D’ABORD » démontre le pourquoi le Bureau actuel du CGE ne devrait pas organiser les élections législatives partielles.

Suite à un cas de double violation grave des textes légaux. Notamment, la violation de la décision n° 0025/CC de la Cour constitutionnelle du 15 juin 2020, et la violation de la loi électorale n°07/96 du 12 mars 2016 portant dispositions communes à toutes les élections politiques déjà modifiées quinze fois, la Plateforme Citoyenne et Patriotique « GABON D’ABORD », a tenu à dénoncer face à l’opinion, l’illégalité et l’illegitimité dont est entaché le Bureau du Centre Gabonais des élections (CGE) depuis le 02 mai 2022. C’était à travers un point de presse, animé ce lundi 19 septembre 2022, par le Président de ladite Plateforme, Jacques Adiahenot, en présence de quelques leaders des Partis politiques de l’opposition.

Pour rappel, le nœud de la problématique soulevée, émane du Conseil des ministres du 1er septembre 2022, à l’issu duquel, il a été adopté la proposition du chronogramme présentée par le bureau caduc depuis le 2 mai 2022 du CGC pour les législatives partielles prévues en octobre prochain.

Le Président de la Plateforme Gabon d’abord, Jacques Adiahenot, rappelle dans sa déclaration que « si ledit mandat a été prorogé plus de deux mois après expiration du délai légal, comme l’a fait observer la Cour constitutionnelle elle-même dans son deuxième considérant de la décision n°0025/CC du 15 juin 2020, on peut affirmer que cela constitue un renouvellement implicitement accordé à ce Bureau du CGE sortant qui n’est dorénavant ni légal ni légitime » A-t-il rappelé.

De plus, pour renchérir cette contestation, le leader de la Plateforme, aura également démontré que les tenants du pouvoir n’ont pas daigné procéder au renouvellement du CGE après la levée des mesure barrières contre la Covid-19 arrêtées par le gouvernement suite à quatre décrets à savoir, le 0088, 0089, 0090 et 0091. Or, la décision de la Cour constitutionnelle citée en sus, voudrait que la date du renouvellement de cette instance soit fixée après la levée des mesures liées à cette crise sanitaire. Mais rien n’a été fait comme prévu.

En conclusion, la Plateforme Citoyenne et Patriotique Gabon d’abord, par la voix de son Président, interpelle les institutions en charge de ces questions, face à ces irrégularités afin qu’elles se persuadent de ce que le Bureau caduc du CGE ne devrait pas organiser le 19 octobre prochain, en marge de toute légalité et légitimité, les élections législatives partielles du 1er siège du département de l’Ogoulou, du 2ème siège de la Zadié et du 1er Arrondissement de la commune de Tchibanga ; ce d’autant plus que l’article 12g de la loi n°07/96 du 12 mars 1996, portant dispositions communes à toutes élections politiques en République gabonaise, modifiée, dispose que ;

« La durée du mandat des membres du bureau du Centre Gabonais des Elections est de deux ans renouvelable une fois. Le renouvellement des membres du bureau du CGE intervient un (1) mois avant la fin du mandat »

Following a case of serious double violation of the legal texts. in particular, the violation of Decision No. 0025/CC of the Constitutional Court of June 15, 2020, and the violation of Electoral Law No. 07/96 of March 12, 2016 laying down common provisions for all political elections already amended fifteen times, the Citizen and Patriotic Platform « GABON D’ABORD », wished to denounce in the face of public opinion, the illegality and illegitimacy with which the Office of the Gabonese Center for Elections (CGE) has been tainted since May 02, 2022. it was through a press briefing, hosted this Monday, September 19, 2022, by the President of the said Platform, Jacques Adiahenot, in the presence of some leaders of the political parties of the opposition.

As a reminder, the crux of the problem raised, emanates from the Council of Ministers of September 1, 2022, at the end of which, the proposal for the chronogram presented by the obsolete office since May 2, 2022 of the CGC for the partial legislative elections was adopted. scheduled for next October.

First, the President of the Gabon d’abord Platform, Jacques Adiahenot, recalls in his statement that « if the said mandate has been extended more than two months after the expiry of the legal period, as the Constitutional Court itself observed in its second considering decision n°0025/CC of 15June 2020, it can be said that this constitutes a renewal implicitly granted to this outgoing CGE Bureau which is now neither legal nor legitimate » He recalled.
moreover, to add to this challenge, the leader of the Platform, will also have demonstrated that those in power did not deign to proceed with the renewal of the CGE after the lifting of the barrier measures against Covid-19 adopted by the government following four decrees namely, the 0088,0089, 0090 and 0091.however, the decision of the Constitutional Court cited in addition, would like the date of the renewal of this body to be fixed after the lifting of the measures linked to this health crisis. But nothing was done as planned.

In conclusion, the Citizen and Patriotic Platform Gabon first, through its President, challenges the institutions in charge of these issues, faced with these irregularities so that they are convinced that the outdated Board of the CGE should not organize next October 19, on the sidelinesof all legality and legitimacy, the partial legislative elections of the 1st seat of the department of Ogoulou, the 2nd seat of Zadié and the 1st district of the commune of Tchibanga; this all the more so as article 12g of the law n°07/96 of March 12, 1996, laying down provisions common toall political elections in the Gabonese Republic, as amended, provides that :

« The duration of the mandate of the members of the office of the Gabonese Elections Center is two years renewable once. The renewal of the members of the office of the CGE takes place one (1) month before the end of the mandate »
